These Terms of Use ("Terms") govern your access to and use of the Alfabird mobile application, the website alfa-bird.com, and any related content, lessons, flashcards, quizzes, or services provided by TOO Lunapp (Lunapp) ("we", "our", "us").
By downloading, accessing, browsing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you are between 13 and 17, you should review these Terms with a parent or legal guardian. By using the Service, you represent that you are legally permitted to do so.
2. The Service
Alfabird is an educational app and website designed to help users learn writing systems and related language foundations through lessons, mnemonic images, flashcards, audio, quizzes, and other educational content.
We may change, improve, suspend, remove, or add features at any time. Some content may be available for free, while some courses, packs, or unlocks may require payment.
3. License
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Service for your own non-commercial educational use.
You may not:
- copy, resell, rent, lease, or commercially exploit the Service or any part of it;
- reverse engineer, decompile, modify, or create derivative works from the app except where such restriction is prohibited by law;
- remove copyright, trademark, or proprietary notices;
- use bots, scraping tools, automation, or other methods to extract data or content from the Service;
- interfere with security, availability, or normal operation of the Service.
4. In-App Purchases and Billing
The Service may offer paid content, course unlocks, or other digital goods through Apple App Store or Google Play. Unless explicitly stated otherwise at the point of purchase, paid content in Alfabird is currently offered as one-time digital unlocks and not as automatically renewing subscriptions.
All payments, billing questions, taxes, refunds, and store account issues are handled by the applicable app store under its own terms. We do not process payment cards directly and do not control store refund decisions.
5. Ads and Third-Party Services
The Service may contain advertisements, attribution technologies, analytics tools, app store integrations, or links to third-party websites and policies. Your use of third-party services is governed by the terms and privacy policies of those third parties, not by these Terms.
6. Educational Content Disclaimer
Alfabird is provided for educational and informational purposes only. We do not guarantee that use of the Service will result in language fluency, exam readiness, academic credit, or any specific learning outcome. Progress depends on many factors, including your time, effort, and prior knowledge.
7. User Conduct
You agree not to use the Service in a way that:
- violates any applicable law or regulation;
- infringes intellectual property, privacy, or other rights of others;
- introduces malware, malicious code, or harmful interference;
- attempts to gain unauthorized access to the Service, systems, or accounts;
- uses the Service for fraudulent, abusive, or deceptive purposes.
8. Intellectual Property
The Service, including the app, website, design, text, audio, lesson structures, mnemonic images, graphics, logos, and other materials, is owned by or licensed to TOO Lunapp (Lunapp) and is protected by intellectual property laws. These Terms do not transfer ownership of any intellectual property to you.
9. Availability, Updates, and Compatibility
We aim to keep the Service available, secure, and useful, but we do not guarantee uninterrupted availability or compatibility with every device, operating system version, region, or app store policy. We may release updates, bug fixes, improvements, or content changes at any time, and some features may stop working on older devices or software versions.
10. Suspension and Termination
We may suspend or terminate access to the Service, in whole or in part, if we reasonably believe you violated these Terms, caused risk or harm, or if we discontinue the Service. Sections that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, and governing law, will survive.
11. Disclaimer of Warranties
To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.
12. Limitation of Liability
To the maximum extent permitted by law, TOO Lunapp (Lunapp) and its affiliates, officers, employees, licensors, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, revenue, profits, goodwill, or business opportunities arising out of or related to your use of the Service.
Where liability cannot be excluded, our aggregate liability will be limited to the amount you paid to us through the Service during the twelve months preceding the event giving rise to the claim, or the minimum amount required by law if higher.
13. Governing Law
These Terms are governed by the laws of the Republic of Kazakhstan, without regard to conflict of law rules, except where mandatory consumer protection laws of your country of residence apply.
14. Changes to the Terms
We may update these Terms from time to time. If we make material changes, we may provide notice in the app, on the website, or through the relevant store listing. Continued use of the Service after the updated Terms take effect means you accept the revised Terms.
